Personal Injury is one of the areas of law that is most satisfying to work for a client.  The Abrams Law Firm works on behalf of its clients to negotiate and close settlement in a timely and efficient manner.

However, and I tell all my client this, “insurance companies are NOT your friends”.  In a personal injury case, the insurance company represents the other side, or the defendant.   Insurance companies DO NOT want to pay Personal Injury claims.  The insurance companies will literally lie to you, exaggerate to you, and cajole you into the lowest possible settlement.

There are many Personal Injury claims that are very straight forward, yet take months and months and month to settle.  The only reason, Insurance companies want to keep their money, not pay out claims.

If you are injured, you may be entitled to the following Damages:

Lost Wages,

Medical Bill reimbursement

Pain and Suffering

Loss of consortium

And many other related losses

Here’s a dirty secret insurance companies never tell you on a Personal Injury claim:  After you settle you claim, you medical insurance company, if you used one to help get healed up, will also come after you for reimbursement.

Here is an example  of a typical Personal Injury Claim:

You get rear ended in an automobile accident.

You car has $2000 in damages.  This is usually not a problem to get repaired.

You suffer some sort of back trauma.

You visit a doctor and go through therapy.

You use your medical insurances.

After you have take MRI’s, Xrays, etc, and gone through therapy, you add up all the bills.

The total bill is $10,000.  Your medical insurance company paid $7500 of those bills after the discounts, etc.

Your medical insurance company wants their $7500 back as well!  And they will know when you get a settlement.
So, you need a settlement that covers all your bills, plus pain and suffering, and then you will have to go and negotiate the $7500 down with your medical insurer.

Remember, most cases and claims are settled out of court, but often times you still need a lawyer to sue in court to force the insurance companies to play ball.
